He has not worked legitimately since 2008. He was denied SSDI (said he is misusing pain prescriptions and is untrustworthy) and is now trying again for a different injury. He is avoiding paying child support, CSEA has taken him into court, he will owe til I die having not ever paid support yet escapes felony charges. I cannot afford a lawyer, legal aid will not handle CSEA cases. I now need Medicaid to pay for my insurance premiums and help with prescription costs as he left us homeless and without funds. I am in retirement due to health concerns, can no longer work but I have worked up until now. I receive a small pension and SS retirement having enough work credits. Any stimulus that he received was forfeited to the state of OH to repay them for the 2 years that I was on TANF while I reorganized our lives to get back on our feet. He has no attachable funds for my SS either as my own work credits are more for the past 10 years.

If you are on Medicaid and receive 80k, your Medicaid will probably stop. You will then have to pay for ur own insurance until u spend the 80k down. The question is, will they want back what they put out prior?

if You get the money, then talk to a caseworker or a lawyer about how to handle Medicaid.

I however doubt you will be seeing any from an unemployed drug addict who can’t even get ssdi. Even if he did, he’d owe you what, 400 month?

Not even the authorities can get blood from a turnip. And if you’re in retirement, your children are probably grown, making recovery even less of a priority. I would minimally worry about it as far as Medicaid goes

Sounds like he has worked under the table so he hasn't gotten credit for his work for Social Security Benefits. I used to warn people about that when I worked for the IRS. Anyhow, if you are just going to have regular Medicaid insurance, not long term care Medicaid for nursing home, I don't believe the state would go after the back child support for that. They might if there is still any unrecovered TANF (welfare benefits). However, IF you got that back child support all at once you might be ineligible for awhile till you had to spend it all on your support. How realistic to actually worry about that back support now if the state didn't nail it sooner? If he should get a big chunk of money from a lump sum Social Security Disability claim the state could siphon off a decent percentage of it as it could be offset for child support. Make sure the state knows he's trying for Disability. Also, if the kids are still minors they could get SS dependents benefits if he gets approved, or under your claim.

I think you'd have to ask your Medicaid caseworker, I don't know the answer to that. Lets say a miracle occurred, he hit the lottery and you get paid the $80k all at once. That likely would put you over the limit for any Medicaid eligibility. If he does get SSDI, can that be attached? If so, how much per month? I'm assuming it would be a percentage if the check is allowed to be attached for child support. Normally SS and SSDI checks are exempt from creditors, but I think child support may be different. Hopefully someone else can chime in who knows. But if you do collect from his SSDI, would that bring you over the limit for Medicaid? I think you need a Medicaid specialist to answer those questions. How is he surviving by the way without any income?
