Can your mother tell you whether or not she's executed a DPOA? If not, you may have to get access to her checking account statements and look through them for evidence of payment to an attorney.
I don't understand though nor does it make any sense that your mother's doctor would write a script for your brother, unless he's treating with him/her as well. Doctors don't just write scripts for relatives or people who aren't patients.
