Retired schoolteacher with dementia passed away at the nursing facility she resided at for 15 yrs. She had Social Security benefits as well as penision which paid for the cost of the facility which was $3500 per month and the extra money was to be into an account which is now zero according to the nursing home. The Nursing home purchased an additional plot for her for $10,000 with no authorization and no records of any financial transactions to show where her money was spent. She pre-paid funeral expenses including a plot and now the nursing home has used her money without authorization for other unknown items. There is no money left in her account and now they are charging for extra funeral costs. I believe they have been using the money in her account without authorization. Now who’s going to pay for the burial? There is no money left and what can we do? The body has been in storage for 3 weeks.

I have never heard of a NH being charge of an individuals money. The only thing they should be overseeing is the Personal Needs acct and they should not be pulling out any money unless authorized.

I too think Medicaid is involved. If so grandma had to spend down all her assets to receive Medicaid.

If grandma has children, they need to handle this. They can ask for an accting. They can call the State Ombudsman. If they get nowhere they can hire a lawyer.

She should report to APS and ask they open a case to investigate, or at least meet with her with administration and ask for proof and for explanations; also can contact an attorney with her evidence. Of course this assumes that she is either executor or WAS the POA (that disappears upon death. Whomever is opening a probate would be the one to investigate this, as well. Nursing homes DO cost more than 3,500.00 a month, so whomever was POA and had the financial records would be privy to this I would think.

Something is missing here. Who had POA or guardianship of grandma? Someone should have been doing the accounting and overseeing the financials. Normally nursing homes cost much more than $3500/month. Was grandma on Medicaid?
