APS recently opened a case saying that our grandmother was being medically neglected by us and that we were stealing money from her. She is starting to show signs of dementia, but is not near as bad off as they say she is. We HAVE NOT done what they are claiming we've done! She has told them time and time again that thier claims aren't true, but still they have put a restriction on her bank account and they are trying to grant a guardianship over her. She has never been late in her life on her bills, but since they've come into the picture she has been late on every single one. Not because she doesn't have the money, but because she does. They wont let her into her own account to pay her own bills.
She wants to file a complaint against them but we are unsure how and she also wants to hire a lawyer, but they wont give her access to her money to pay for one. What should we do?
How you fight against APS is to be open and honest with them. If Grandma has not been declared incompetent by her doctor or doctors then no one can get Guardianship.
If this is a case where APS has stepped in where they shouldn't and it is obvious then any GOOD lawyer would take the case and wait until the case has been settled to be paid. In many areas there are low cost lawyers or ones that will take a case from a Senior that needs representation.
And if this is a case where APS should not have stepped in a lawyer would milk this for all it's worth in the media.
