Under contract with deceased relative as sole caregiver I submitted my out of pocket receipts and my deferred compensation statements/invoices to deceased hired trustee who sent out 11 Notices of Proposed Actions to beneficiary's for payment of deceased debt. 8 did not object and 3 did. 2 offers were made by me to settle this out of court rejected. Now the trustees attorney told me he's filing a petition and it could take 6 months. There is more but lets start there. Thank you and Merry Christmas. What will happen in court? I can not find afford a lawyer and the combined out of pocket and deferred wages is $53k I made 2 offers reducing it to $40k but they were rejected. I feel now that if my offers were rejected that bringing this matter to court I should ask the court for the original proposed actions value.
The whole point of a discount was to avoid court, you don't get the discount when it has to go through the legal system.
Best of luck! Let this be a warning to everyone that thinks that they will get paid after death, get a pay as you go contract to avoid a legal hassle.
The 3 that are not wanting to pay will find out that they are paying the legal expenses for both sides and their inheritance is shrinking rapidly by involving the courts and attorneys. Hopefully the other 8 make them pay from their share.
