Caregivers of any kind are regulated, and must be background checked.
Businesses of any kind are licensed and regulated.
Health Care Businesses are licensed by the state health department.
Medicare rules also kick in if this is paid by them.
Freelance cooks, housekeepers, companions and chauffeurs are sometimes hired and paid for out-of-pocket by private individuals. These are then employees of the patient, who has to establish payroll and withholding, and pay workman's comp insurance and FICA taxes and get an EIN number.
Many times there are under-the-table payments which leave both parties open to lawsuits from either side, and fail to protect either one from disagreements over care.
