I've been casted out by my sister (5 yrs older than me) and her children and their children for many years. She's been taken care of by our mother all of her life and still is at 58yrs old. I recently found out about one of our mothers credit cards having a past due amount and my sister is to blame. Our mother is 88yrs old and starting to lose her memory. I confronted my sister and threatened her and her boyfriend of being guilty of elderly abuse. Now her daughter, my niece has filed P.O.A. on our mother primarily to keep me out of the picture. What can I do?

I agree that POA is not something that is filed "over" someone. It usually begins as a discussion between 2 people where the elderly person designates someone to act on their behalf if they (the elderly person) become unable to act on their own behalf for whatever reason. It's a legal document.

It isn't uncommon to pick someone from a younger generation to act as POA, in fact it makes much more sense than naming a spouse who may predecease you or a child who is irresponsible with money (as it seems your sister is). And if your mother has always had a closer bond to your sister's family it is only natural that she would look to one of them rather than you and yours.

Oh and BTW, POA is not something you "get" in order to rule over someone else, it is something freely given, and a legal responsibility to act in accordance with your mother's wishes.

Not much here about mom and her needs...it's more all about you. Mom gave her POA, maybe because they are there for her. Not too clear about why it's sister's fault mom is behind on a credit card. This sounds like a sibling issue of long standing which is now bubbling up around the latest topic of mom. What outcome do you want? Take over for mom yourself? Cut mom off from sister's side of the family? What's the relationship you have between you and mom? If you know what you want to achieve it's easier to get advice on how to do it.
