need need to find the information out on discharge plans from patient rehab/ nursing home was told that we could not finally cannot be released to come home today because of doctor was not there to sign off on his paperwork and that we would be for the bill which is insurance company and we prior to this they already knew we had a staff meeting and we were we already let them know that we were going to be picking him up but then weeks days and they still not release him today when we went to go pick him up what are the law on this? are they allowed to hold you against your will which we already had everything in place the day that we've picked him up was they were going to show us everything that we needed to know to take care of him we got home so it's not like we didn't have nothing in place doctor was not there so they told us that we could not take him or we were want to have to pay the bill can they hold you against your will like that I need some insight please?

For a discharge, the Doctor has to sign the papers. Are you being told that if you take him out AMA (Against Medical Advise) that you will have to pay. Thisvis not true, its a ploy. Medicare and suppliments pay for the time in the facility. They don't care if u leave on ur own. But, if you go back to the hospital for the same problem and its found you did an AMA, you maybe charged. No, you cannot be held against your will but you may have to pay the consequences for going AMA. Also by going AMA, the facility does not have to give u prescriptions or set you up with in home care.

Didn't happen in my case. ( Last time saw facility Dr was Fathers Day 2023) In fact, no discharge info in my medical record, even though there was a discharge date.

Did things by the book and still was cheated only getting prescriptions before leaving. SW probably b''' hurt over losing the appeal, so this was one last chance to feel good about himself.

Please, in order to understand more specifically what you need to know and why, add punctuation to your post AND more info:

Who is the person being held (in the hospital? or other type of facility)?

Is the person capable of making a decision about being discharged or their future care?

Are they cognitively impaired?

How old is this person?

Are you their PoA? Family member? Caregiver?

Why was this person in the hospital to begin with?

This I can understand, "can they hold you against your will like that I need some insight please?" Anybody is free to leave a hospital or rehab AMA, against medical advice, any time they'd like. These places are not prisons and nobody is held captive, just because a doctor does not sign discharge papers. Whether insurance will pony up the charges for a patient who leaves AMA is a question for the insurance company.

Side note: it’s often mentioned, and I’m glad you brought it up, but turns out AMA does not affect insurance payments for the stay up to that point. First , it shouldn’t matter if you think about it (insurance pays for medically necessary care; your prior care doesn’t become medically unnecessary retroactively just because you decided to leave on day 5). More to the point l, two studies in Chicago as I recall (one in ED, one inpatient) looking at this, and AMA discharges were paid just like any other stay (a few were rejected, but had nothing to do with the AMA part).

Have you checked the discharge laws in your state? The facility is supposed to follow these.

Get in contact with your state ombudsman for some advice and guidance.

I am truly sorry, but I am choosing now not to read paragraphs without punctuation and capitalization.
Of late we are getting a lot of these and they are truly impossible for me to untangle and understand. I feel as though we--most of us--on this Forum take our time and effort to provide real answers to any real questions. It seems disrespectful at best to write us something that requires out combing out sentences.

I am curious. I am seeing this stream of consciousness writing more and more. Is it a new A.I. program or real people who have just decided that periods, paragraphs and capitalization just takes too much time.
If you can only answer without punctuation, it's OK. Don't bother.
I do wish you good luck with whatever problem you are facing down. Slow down. Take your time. Think it out. I bet it will all come together.

Alva, I (and expect you) type our answers on a computer with a proper keyboard. I think a lot of these 'stream of consciousness' people do it with their thumbs on a phone. Not an excuse, but perhaps one of the ways it's easier. However they also usually can't spell and use lots of abbreviations, so probably this poster has just chosen to act as though they had nil education. If they can't bother, why should we?
