my 98 yr old husband had a foley indwelling catheter and staff put him in hand and chest restraints for 36 hours for fear that he would remove the catheter. It was so, so pathetic to hear him begging to remove so he could at least lay on his side as he usually does, to sleep.

1sirmionne, please give us more information. What is the issue with the patient in the hospital? Why would that patient need to have restraints or is that patient being restraint? Is the patient trying to get out of bed and cannot walk?

Do you mean does the patient have the right not to be restrained? In general, yes.
