What should we do with Social Security money adding up?
My father helped his brother-in-law get onto Medi-Cal and into a nursing home. When applying for Medi-Cal they allowed my dad to split my uncles money because his name was on the checking account and to also keep his Social Security. My dad doesn’t use that money but when he has to reapply for Medi-Cal there will be too much money in my uncles account what should he do with that money? He wants to save it for my uncle just in case.

Good thing he’s saving it and hasn’t spent it...the “just in case” is going to be him repaying Medicaid with it after he straightens out the mistake.

So you know that the authorities mistook your dad for his brother's wife, that is fraud when you don't clarify that they were mistaken.

Your dad needs to step up and clarify what the situation is, at this point he is stealing from the taxpayers so he can financially benefit. (I don't think that they assumed anything, I would bet they were led to believe that they were married.)

I for one think that this kind of fraud carries some prison time, does he think that it is worth it?

absolutely not! My dad is a very honest man!! He was completely honest with them , we were very surprised when they did not make my uncle pay any of his SS ! Maybe they will change this this year

Wanting to save this money “just in case” may very well bite you. The SS money should be going to the nursing home, that it isn’t is a mistake that will likely be caught and be required to be repaid.

I agree, your Dad misunderstood. When he applied for Medi-Cal he had to include SS as income. That SS and any pension goes to offset the care of your Uncle. A small amount of his SS is put into a Personal Needs acct that Uncle can draw from for personal needs. I would bet that your Uncle has a balance with the NH and the billing dept hasn't caught up to him yet. Dad needs to talk to the finance dept at the NH. If an error has been made by Medi-Cal, it needs to be rectified. SS nedds to go towards his care.

I think because my uncle lives in San Fransisco, and my dads name was on his account they may have assumed they were partners, and have allowed his ss to not have to be used for home. He is going to open another account in just his name and transfer money into each month. He wants to save it incase for some reason my uncle may need it.

The social security should be going to the nursing home. If medi-cal is paying for the home, he doesn’t get to keep his social security. Why would medi-cal let your dad keep his dads social social security? I think your dad misunderstood stood something. He’s not allowed to keep someone else’s social security check.
