How can I stop the attorney who said she would have everything be fully transparent from spending my families money on services that I can do for nothing. The elder advocate at 80.00 an hour, I realize some other's cost even more. She has run errors, taken my father back and forth to nursing home and ordered the wrong bed which Medicare won't pay for than had to reorder the one they will approve all for a large fee for herself. I told the attorney I was not happy about this nor about the expense of the move of which was not discussed with me. I had to ask the senior advocate what she was being paid the attorney didn't advise me. Now I regret in a big way allowing her to spend my parents money the cost of the facility alone is a down payment on a house and that's every month. Once the facility spends all their money they will have to move to a nursing home where Medicaid will take over I was not made aware of this until I arrived in Virginia.
How can this be stopped I don't feel I can trust anyone now.

If your parents are incompetent to the point where they needed a guardian, I doubt they can sue anyone or insist on changes. The guardian is responsible for making decisions on their behalf. The decisions may not be the ones you would make, but you are not authorized to make decisions. I don't see any fraud here, unless you haven't told us something. The guardian decided on a facility and is seeing that it is paid for. Not the one you would pick out, but nothing fraudulent about it.

I am very sorry that the arrangement you made is not working as you expected it to. What would you want as a solution? Do you want to be guardian? Do you want someone else to be appointed guardian? If you like you can certainly see a different attorney for an opinion as to whether you have any chance at getting your desired solution, and if so the best way to go about it.

If you can document substantial abuse, you should show it to your parents and see if they are willing to help you sue. At least show it to another attorney to find out if there is any remedy. A private investigator may be able to find out if there is fraud or collusion involving the facility. Medicare and Medicaid fraud is rampant, but it may be expensive to stop it.

The attorney doesn't answer to you, she answers to the Judge who appointed her as Guardian. From what you have written, she has not done anything illegal. Your chance to speak was in court, not now. If you were willing to do things for free you should have said so to the judge. Apparently your parents are happy, so let it be.

NEVER trust an attorney with money! Transfer the POA to the most trusted and responsible relative or friend. Even then, people will still be people.

Fire your attorney. If you must, go to aging center and ask for a referral to another geriatric specialist attorney and ask the aging center or senior services director to help you seek options. Also, you can talk to the NH or residential facility and they have legal services on retainer that might be willing to give you a free consult.
