Thank you to all who responded to my very long post. Has anyone here reported aDPOA for breach of fiduciary?

I don't know that I have personally heard of anyone on the forum who has actually DONE this; but I do know HOW it is done.

A POA has no obligation to share their business, or the business of the elder they represent with ANYONE, even other family members. In fact, without express permission by the person who appointed them they SHOULD NOT discuss their financial affairs.

HOWEVER the POA is responsible for keeping meticulous records of every single penny into and out of an account. An onerous task. I did it for my brother serving as both his POA and his Trustee. It represents hours of work and filing and sening POA papers everywhere.

Now comes the question of any suspicion that a POA is enriching themselves or is incapable of keeping needed records and doing needed duties. IF this is the case you see an attorney and bring along whatever PROOF you have of your suspicions, then ask that a court action take place in order for the court to call the POA to account with their records for their actions.

If the POA did the job correctly they will have the files to drag in, one for every bill and taxation process and bank account, and investment. I myself even kept a diary in a composition book with no tear outs and only cross outs for errors. I had also provided to my brother a monthly accounting of his own.

So this is a legal action. See an attorney. Bring what PROOF you have of malfeasence. That attorney will walk you through the process. And it will have attorney fees, being a court action.

When you find a lawyer to advise you, I would include in your questions to your lawyer is there a possibility that, should the judge find your case lacking and rule in favor of the POA, you might be instructed by the court to cover the POA's court costs. This is not unheard of in civil judgements.
