my brother has been in a rehab facility for almost a year. he has medicare, medicaid and bcbs. according to the facility all of his monies has to be turned over to them. my brother has a house note, and insurance that I have been battling to pay along with my own bills. this is all new to me, I feel like they are harassing me about this. I don't know if he will be able to come home anytime soon. his ssi is already going to nursing home. I am very lost and need some guidance on what I can do .

They are correct. All income goes to them for his care. There is nothing left for mortgages, insurance, utilities or anything else. A POA who holds back any income can be sued and the facility will win judgment. They will also recover any payments from his estate (the house if he owns it). Do not pay any bills on his behalf, you are not responsible for his debts.

I think you should consult an elder care lawyer about this. It is usually for medicaid to take all monies unless a person is married then what is called the community spouse has some rights. If you have evidence of all the bills you have paid on his behalf you should be able to claim these monies back. His year in rehab has already cost $50 -!00K so that gives you and idea why Medicaid tries to recover as much as possible to lesson the cost to other taxpayers like you and me. Does not seem fair but the money has to come from somewhere.
