A 75 yo Cousin in a DE nursing home, DE Medicaid involved, can she sell her car and keep the money instead of the first two. Because of illness cousin was taken from her apartment to the hospital and then transfer to a nursing home. Home says she has no PT scheduled, She is in bed all day with exercises. The nursing home is now her social security payee, and now she can't afford to keep her apartment or car. She stands to lose it all. Her belongings in the apartment are in danger. The value of the car could be as much as $18,000. Does anyone have a legal right to her processions?
Is she expected to recover from her illness and return to her apartment, and to driving?
She asked her neighboir to help sell the car so she can have money to pay September rent, pay her auto insurance, to have friends empty the apartment into a storage unit while she rents an apt on one level. She has friends drive her to doctor appointments and food stores.
Although the nursing home is saying that she cannot leave, she is not strong enough to live alone. Her Physical Therapy paid by Medicaid has been used up. Not to receive more PT this year.
Carol is very alert and upset that this is happening, and worried she will lose everything. I am myself on SS and can't afford to help her with money.
