My dad did a life estate deed. He fully owned his home during his life. When he died the home immediately became mine. He had 2 credit cards but paid them in full monthly and I paid the remaining balances within a month of his death. The credit card companies both got extremely nice to me, knowing I didn't have to pay, but wanted to do the right thing. Perhaps if you contact your creditors and offer to do a payment plan and honor that, any lien will be removed. It’s worth a try

I don’t think your experience is relevant to OP’s question. You agreed to pay your father’s bills, which was appreciated, but it’s not really relevant to the life estate question or the lien on the title.

You don’t want to take ‘no’ for an answer? If you own the property, subject to your daughter’s life estate registered on the title, then the lien will be put on the property title too. I don’t think twisting will get you out of the debt.

I would suggest that the attorney who did this work for you answer these questions for you. We have no idea of what papers you have done with your elder and the attorney; we have no idea how these Trusts and or deeds are titled. We have no idea who owes what amounts to credit card companies. I am afraid you will need to handle this with your attorneys. The more complicated these issues become--well-- the more complicated they come. RealyReal answered your first question that is a company goes to court and gets a judgement then they are able to do a lien on any real property. That certainly sounds correct to me.

As I said, do check with your attorney.
