I've cared for dad 12 yrs 24/7. I got hurt caring for dad & was hospitalized, then sent to rehab. The poa told me not to return & to find somewhere else to live. He plans to sell the house, am I entitled to a share of the sale of the house? During the 12 years I cared for dad, I worked ALL WEEK ENDS & HOLIDAYS & he payed me in cash & stated if I contest the will, I'll receive $1.00. Is this legal in the stat of Calif?
Sometimes the testator/trix can include a clause accompanying the in terrorem clause providing a nominal $1.00 bequest to specific heirs.
I would think that these types of clauses aren't typically included in "homemade" wills unless the testator/trix is an attorney. I rather doubt that nonlegal people who do their own wills would be familiar with this type of limitation.
Even though I'd worked in estate planning law firms periodically over the years, I had never become familiar with this concept until our attorney told us about the concept.
Why would you work 24/7 for 60$ per month? Did you have a caregining contract?
Your brother may be POA with ability to sell the house if in fact your dad gave him that power but it is your dad's will that will determine how his estate is divided among his heirs once he has passed
