My father is in a nursing home. The state gave power of attorney to his sister while I was a minor child. Can I take over as power of attorney How do I go a bout it. None of his siblings ever visit and any money he receives is never spent on him.. I am the only one who purchase anything for him, clothing, etc. He also received money from a Native American Tribe, which NONE has been spent on him. We believe it has been used for the siblings own benefit.

The issue is not the money. I just want to make sure he has what he needs...clothing, etc. I feel that I would be able to this. The facility was not even aware that he had any family other than myself.

The State gave Power of Attorney to his sister? Is your Dad a ward of the State due to medical issues? Is his sister his legal guardian?

Is your Dad under "Medicaid"? If yes, then any money he receives goes directly for the cost of a nursing home. Nursing homes can be very expensive. The one my Mom was in was $15,000 per month.
