Mother is in a nursing home and only has enough money for maybe 2 more months. I've heard it can take at least 3 months to get approved and I've also heard you will get denied a couple times before getting approval. We don't have the time. I've also heard Elder Law Attorneys charge around $7,000. Is this correct?

If your Mother is running out of money, and doesn't have any assess, the progress could go smoothly. It all depends on what was the financial history during the past 5 years. If it was complicated, it could take time.

As for how much an Elder Law attorney charges, it depends if he/she charges by the hour or by the document group. Also if the attorney is part of large city firm, or is a sole attorney out in the burbs. You would need to do your research.

No you don't need an attorney. Things just take a long time because of overworked public employees. When she's approved it will be retroactive. The providers know this. Don't waste money on an attorney forthis.

You don't need an attorney. The Nursing Home is required to help you through the process. You make them representative payee for SS and supply full financial disclosure for the last 5 years.
