Based on your preferences, we provide you with information about one or more of our contracted senior living providers ("Participating Communities") and provide your Senior Living Care Information to Participating Communities. The Participating Communities may contact you directly regarding their services. APFM does not endorse or recommend any provider. It is your sole responsibility to select the appropriate care for yourself or your loved one. We work with both you and the Participating Communities in your search. We do not permit our Advisors to have an ownership interest in Participating Communities.
II. How We Are Paid. We do not charge you any fee – we are paid by the Participating Communities. Some Participating Communities pay us a percentage of the first month's standard rate for the rent and care services you select. We invoice these fees after the senior moves in.
III. When We Tour. APFM tours certain Participating Communities in Washington (typically more in metropolitan areas than in rural areas.) During the 12 month period prior to December 31, 2017, we toured 86.2% of Participating Communities with capacity for 20 or more residents.
IV. No Obligation or Commitment. You have no obligation to use or to continue to use our services. Because you pay no fee to us, you will never need to ask for a refund.
V. Complaints. Please contact our Family Feedback Line at (866) 584-7340 or ConsumerFeedback@aplaceformom.com to report any complaint. Consumers have many avenues to address a dispute with any referral service company, including the right to file a complaint with the Attorney General's office at: Consumer Protection Division, 800 5th Avenue, Ste. 2000, Seattle, 98104 or 800-551-4636.
VI. No Waiver of Your Rights. They are now saying I have to pay for the whole month of April, when at first the rep told me I had until 4/30 to even decide if I wanted to keep her there permanently. I understand taking it after 4/30. I am unsure if I have to pay this.
Well, the only check they may be entitled to would be the one received in April that really covers March. SS is like a job, you get paid after the work is done. Because Mom died in April, u should not have gotten one for May. If you did, they may take that back. If Mom was on Medicaid or pending she has no money. Maybe the spend down money. No money, they can't get anything out of you unless you signed you would be responsible. If u signed as POA your not responsible.
Reread the admissions paperwork to see exactly what the financial responsibility is. What someone “told” you doesn’t matter, it whats in the contract that matters. This bill is going now into 6 months, so what has been happening with the bill since April?
if she was having her SS go to the NH, I’m guessing that she had applied to or was on LTC Medicaid. Is that correct?
If so, those last few days in March should have been prorated to pay divided by 31 from her SS income for March. If it was Medicaid, she’d be there via Medicaid Pending admission. Then for April, I bet her admissions contract has it so that she would have been responsible to pay her entire SS to the NH, if at the time of her death, she was still Medicaid Pending for her LTC Medicaid eligibility.
if she died before getting eligible for LTC Medicaid, her old dpoa need to continue her application and get her eligible even if it’s going to be retroactive eligibility. If not, the NH can try to Bill whomever full private pay rate for her from 3/29 to end of April less whatever SS$ she paid on her account.
If it hasn’t gotten settled yet and your at 6 months out, they are going to turn it over to collections for the maximum payout / private pay rates. Unless you opened or will be opening probate for your mom, the NH and the debt collectors are going to bill you. Your going to have to be able to prove that your not responsible or that Medicaid is going to retro her eligibility.
Did you sign a contract when your mother entered the facility? Either way, you know she wasn’t there on a free trial. At the very least, you have to pay for all of the days she was in the facility. Whether or not they will pro-rate it, depends entirely on the contract you signed when she was admitted. What does that contract say?
