I was with this friend 14 yrs, dementia. I'm POA and power of attorney for health. Can I take control and get him out of this place now? I was overwhelmed but not now. Can I take my POS POH to the police and go to home and remove him?

The fact that all this happened without your knowledge puzzles me, I'm not being judgmental here but did you burn out and dump him at the hospital and run? If that is what happened the State may have been awarded emergency guardianship, which supersedes your POAs.

The POA generally does have the ability to arrange for a different living situation for the person. But you probably need to develop a safe discharge plan. Start with the facility he is in. Ask them for a care plan. Arrange care. Discharge him.

You can also initiate a lateral transfer to a facility you like better. Just get a plan together and get him out of there safely.

So, what you’re saying is that your friend was transferred from the hospital to a group home and you were never notified? Does he have family who approved the transfer? If he has dementia, he is not able to sign anything.

Go to the administrator of the group home and find out who approved the transfer. Ask if they are aware you have POA. Is this Durable POA or just financial? Who is paying for this group home care? Medicaid?

You say he “is a zombie”. Why was he in the hospital. Was it a stroke? Could this place be a rehabilitation facility? Could he be there for therapy? If you want him removed, you will need to prove he has a place to go that can provide him the care he needs. If he has greater health care needs than he had before he went to the hospital, you may no longer be able to care for him.
