My brother has a personality disorder. He could never keep a job. He is on SSI and Medicaid. I will consult moms lawyer who wrote the trust. But didn't want to be constantly asking questions. Plus would like emotional support dealing with difficult brother.

YES see the lawyer, because if mom was a trustee for him, or his Guardian, this has to be re-arranged. If he is difficult, find a third party trustee who can take the heat. Save your sanity.

He doesn't have a guardian. He can take care of himself.
I am the trustee, I guess. I am named as the person in charge of the trust.
Before mom died the lawyer mentioned a pooled trust. I guess that would be cheaper than hiring an individual lawyer to run the trust. But still I don't want to spend too much money thats not for brother. Mom wasnt wealthy. Dont know how long money will last.

Barbara, stop for a second. Please.

To my knowledge, a pooled trust was mentioned as a way to qualify your mom for Medicaid. If she had lived, she would have needed Medicaid to fund her NH care.

Go back and talk to the lawyer and take another adult with you who can ask questions, so that you can understand this with greater clarity.

Barbara, go to Lexisnexisdotcom and search "pooled trust". I'm unclear what the attorney was suggesting. A pooled trust for your mom or for your brother. I think $s $ for legal advice is money well spent right now.

Barbara, if your brother is getting Medicaid/ ssi, then disbursement from the trust need to be in compliance with maintaining his eligibility for those supports. Does he have a caseworker you could speak with?

Please remember that first and foremost, you need to go see your doctor tomorrow and have your physical symptoms ( lightheadedness, etc) checked out.
