My mother has been showing early signs dementia for a few years. Recently I found out she upgraded her time share membership to something that costs $1000/month, which she can no way afford. It was being charged to a credit card, until the card was maxed out. Now they keep calling and want their money. Is there anything that can be done? Some way to prove she wasn't in her right mind when she signed this contract?

Can you try to sell the timeshare? I don’t know about getting out of the contract but.....i can tell you that these time share companies are ruthless. My parents bought one in 1998 and they still owe $22k on it 20 years later!! It should have been paid off years ago but at least twice, when they went to Vegas & stayed at the time share they were talked into upgrading or buying in to a new property! They are both technically in their right mind, turned 79 this year, but have always been easily convinced to do these stupid things! My mom FINALLY had enough this summer and contacted the time share company & had them put it up for sale so hopefully they get a buyer soon. Good luck!!

Has she been diagnosed with any type of Dementia? If so she may not have been able to legally enter into a contract.
Trying to sell a time share is almost impossible.
Most churches or charities will not take them as a donation.
If she has no income other than a pension or Social Security it might be best to declare bankruptcy.
This might also be a time to consult a lawyer, Elder Care would be the best.

I hope others have more solid ideas though.

Unfortunately she has not been diagnosed. She hasn’t been to the doctor in a year and a half. I’m currently fighting to get her to go and get power of attorney. She has always been stubborn, but it is getting progressively worse.
