my husband and I have been married 5 1/2 yrs he has Dementia. I plan on taking care of my husband with Dementia my mother has left me land when she dies. Craig if he were to go to a nursing home can they take my land his name isn't on deed. I pray I can take care of him my daughter is living with me to help nursing home wants 3000 an month and that leaves me only a small amount to live on then they want me to pay for medicaid also 3000 more so I cant put him in a home please let me know about the land his name isn't on it we have only been married 5 yrs thank you char

Let me make sure I understand the situation.

Your mother holds title to land which you inherit on her death. Is that incorporated into a Will or Trust, or are you a joint title holder with your mother?

Your husband is in no way connected to inheritance of the land, has no vested interest in it now and won't when you inherit it.

The nursing home would charge $3k per month and "they" want another $3k? I'm not clear what the additional $3k is for and who "they" are. I aldo don't understand what you mean that "they want [you] to pay for Medicaid."

Could you please explain a little bit more?

Does your husband qualify for Medicaid? Have you applied?

Do you live in a community property state? That might be a way your husband could acquire a legal interest in the property after your mother dies. But I'm not that familiar with community property laws; perhaps others here are. There are some folks here who are also really knowledgeable about Medicaid; perhaps they can provide a better answer than I.

Char, you need a lawyer because you are very confused. The land isn't even yours yet. You don't pay for Medicaid. Get a lawyer, now.

See a lawyer who specializes in Elder Law, and who can help you protect income for yourself if your husband goes into a nursing home, and also to arrange for in-home help in the meantime. Please don't say you can't afford a lawyer. You really cannot afford to be without one. Your future depends on doing things right.

I was told by the nursing home they will take all his retirement ss except a few hundred dollars and I would have to pay 3000 more a month back due to they charge 6000 a month So long term Medicaid will make me pay it back I am not confused that is per the nursing home that could add up and they could put a lean on our home

They can put a lien on any property HE owns, including your home. They will not make you move, you stay there, you still have your SS, your farm income. Your assets are safe. If the home is jointly owned you only pay back if you sell the house. Otherwise you live there until you die.
