My mother has polio, is disabled, has high-blood pressure, diabetes, and a tumor she needs removed ASAP. However, she is living alone and barely has enough to live or cover any expenses. The only income she has is her disability benefit and Medicaid. I would like to bring her into my home to take care of and for the sake of her not losing her benefits, how can I charge her for rent/expenses so that she still qualifies for the disability and Medicaid she gets now while she is living with me so that she has medical coverage and some kind of income. I have no intention of taking her money, I am financially stable (thank GOD) and can afford to take her in, however I need to make sure that she continues to get her much needed benefits, especially the medical part and the disability as well since she is paying off a mortgage so she can leave my other sibling with a home (I do not want it)... I just want to be able to help her without her losing the income she gets, any ideas of what I can do?

Pamstegma... Thank you for the answer, to tell you the truth I could care less if he keeps the house or not. He's 36 years old and just needs to grow up. I really just want to get my mother safely over at our place for proper care. If he doesn't get it at the end, then I guess he just will need to work like we all do, too bad

treblarekroc please google Texas Medicaid Estate Recovery. You will find out the real facts. Paying the mortgage for someone else is a gift that Medicaid frowns on. Medicaid does not go after the house or car until she dies, or leaves the premises.

This is treblarekroc, the person who posted the question. I do not believe Medicaid has any lien on the home she owns. She refinanced it 3 years ago using the disability payment she receives as income to get the loan. She wants to give it to my younger brother who doesn't work or contribute at all yet he lives there with her making sure she is always broke to support his habits. I remodeled my home over the holidays to make one of my restrooms wheelchair accessible for her to use and like I said I just want to get her over to my home so that she can be properly cared for but she won't come live with me and my wife unless she can pay for the house payment to give the home to my worthless younger brother, a mother's love I guess. I can charge her rent/etc... but she's going to get it back, I don't need her money at all, I need to take care of her and put her in a loving drug free alcohol free home, I wish for my mother to enjoy the rest of her life in peace. However, she needs to get her disability assistance to pay for the house and secondly have some money she can spend for anything she may need while she stays with me. The Medicaid is for her medical expenses.

Sit down with an attorney and pencil out a care contract. Medicaid will respect a written contract. BUT she cannot leave a home to anyone, Medicaid will already have a lien on it. This is why you need to talk to someone familiar with Elder Law.
