My mother is alive and we put her in a facility. As long as her care costs, bills etc get paid from sale of home, will we be able to also receive any money from sale of home as inheritance?

An inheritance only happens when someone dies. So as long as she is alive, that money goes to pay for her care. That's the law, son, POA or no POA.

Are you asking what are your rights as the sister of someone who holds POA? That answer is "None."

If you are asking whether you and your sister inherit equally, even though she is POA, that answer is that you inherit according to the terms of the will. POA ends at death of the principal and has nothing to do with inheriting.

The difficulty with this idea is that your Mom may outlive her savings and the proceeds from the house. She might end up on Medicaid.

So, after she passes, and after the estate is settled (all the bills paid), AND assuming she does not ever go one Medicaid...then you might inherit.

But, I wouldn't count those chickens yet.
